Terms of Use

1. Agreement to terms

These Terms of Use (“Terms”) are an agreement between you and QParticle LLC, doing business as Endless Questions (“we”, “us”). They apply to the Endless Questions app for iPhone (“the app”) and the website at endlessquestions.app. When you download or use the app, you agree to these Terms. If you do not agree, do not use the app.

You must be 13 or older to use the app.

2. License to use the app

We give you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices that you own or control, for your own non-commercial use. You may not copy, change, distribute, sell, or rent the app or its questions, except as these Terms allow.

3. In-app purchase

The app is free to download and includes 50 free cards. A one-time purchase of 2.99 USD (or the equivalent price in your country, as the App Store shows) unlocks the full deck of 1,000,000 cards. The purchase is not a subscription.

Apple sells the purchase through Apple In-App Purchase, and Apple’s terms apply to the payment. We do not handle refunds. To ask for a refund, go to reportaproblem.apple.com. Apple decides each refund request.

4. Apple’s Standard EULA

Apple’s Licensed Application End User License Agreement (“Standard EULA”) applies to your use of the app. If these Terms conflict with the Standard EULA, the Standard EULA controls. Apple is not responsible for the app or its content, and Apple has no duty to provide maintenance or support for it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

5. Acceptable use

You agree that you will not:

• Copy, scrape, or publish the app’s questions as a collection.
• Reverse engineer, decompile, or change the app, except where the law permits it.
• Try to unlock paid content without a valid purchase.
• Use the app to break any law or to harm other people.

Play with care. Each player decides which questions to answer. You can skip any card.

6. Intellectual property

QParticle LLC owns the app, its questions, the Endless Questions name, the infinity logo, and this website. These Terms do not give you any rights to them, except the license in section 2.

7. Disclaimers

We provide the app and the website “as is” and “as available”. To the extent the law permits, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the app will be free of errors or always available.

8. Limitation of liability

To the extent the law permits, QParticle LLC is not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, that results from your use of the app or the website. Our total liability for any claim about the app is limited to the amount you paid for the app in the 12 months before the claim. Some places do not allow these limits, so they may not apply to you.

9. Governing law

The laws of the State of California govern these Terms, without regard to conflict of law rules. The state and federal courts in San Diego County, California, have exclusive jurisdiction over any dispute about these Terms, unless the law of your country requires otherwise.

10. Changes to terms

We may update these Terms. We will post the new version on this page and change the effective date. If you continue to use the app after a change, you accept the new Terms.
